Four More Victories Against The Banks By The Estavillo Law Group, PC

This past week, The Estavillo Law Group, PC stopped four non-judicial foreclosures in Northern California, setting the precedent to help property owners hold onto their properties and holding more banks accountable.

One of the wins this week was especially satisfying for us and our client as we were able to stop the foreclosure of an income-producing property. Our client was facing the foreclosure of their income-producing apartment complex representing several homes for families in Alameda County. Prior to retaining the Estavillo Law Group, this client was facing a judgment by the Trial Court in favor of the banks. Panicked by the thought of losing a source of their income, the client hired us to handle the appeal of the Trial Court’s judgment.

In the process, the trial judge denied the temporary restraining order which would have stopped the banks from continuing the foreclosure process. Undaunted by the temporary disappointment, we continued with the court process, filing a Petition for Writ of Supersedeas in the First Appellate District to overturn the trial judge’s decision.

The result was a win for our client, as our persistence and knowledge of the court system’s process stayed the foreclosure to allow full briefing of the Writ. This win kept several families in their homes and our clients from losing a significant source of income.

Adding to the tremendous victory is the fact that it’s very difficult to stay a foreclosure when the property isn’t the primary residence, this was an income producing property, and the client owns but does not reside in the property.

Three Other Judgments in Favor of the Northern California Property Owner

The Estavillo Law Group, PC celebrated wins in three other cases. One of our properties was a multi-million dollar commercial piece of property in San Francisco and the other two are located in Contra Costa County, one in Lafayette and the other in El Sobrante.
