On January 14, 2019, the Alameda County Superior Court granted our Client’s Motion to Consolidate/Stay an unlawful detainer (eviction) action with our client’s pending wrongful foreclosure action against Wells Fargo Bank N.A. and Amador Avenue Properties, LLC (“Amador”).

Prior to the wrongful foreclosure of our Client’s home, per Wells Fargo’s instructions, our Client wired the funds necessary to reinstate the loan and bring the account current. Despite this fact, Wells Fargo proceeded with the foreclosure sale, and the property was sold to a third-party, Amador. Now facing an eviction action for possession of the property filed by Amador, our firm filed a Motion to Consolidate and/or Stay the unlawful detainer action with the wrongful foreclosure action, in order to keep our Client in her home.

Given the complex issues regarding title to the property, the Court found that the unlawful detainer action had to be consolidate or stayed pending resolution of our Client’s wrongful foreclosure action. Due to this victory our Client now gets to remain in her home pending full resolution of her wrongful foreclosure case on the merits.
