Another Victory Against Nationstar Mortgage And Wells Fargo

On Friday, March 29, 2019, Estavillo Law Group, PC appeared in Contra Costa County Superior Court, before Hon. Judge Treat, and we were successful in getting a Temporary Restraining Order issued against Nationstar Mortgage, LLC and Wells Fargo Bank, N.A. (“Defendants”) stopping a foreclosure sale scheduled for April 2, 2019. Defendants were attempting to proceed with a foreclosure sale despite our Clients’ submission of a complete loan modification application, in direct violation of Cal. Civ. Code section 2923.6. A formal hearing has now been set to determine whether a preliminary injunction should issue halting any further foreclosure activity on the subject property pending resolution of the lawsuit on the merits.
